Miami Family to Sue Nursing Center After Father Reportedly Contracts COVID-19 at the Facility
The Cochran Firm’s Jack Paris says the infection could have been avoided, the patient is now in critical condition.
MIAMI – April 28, 2020 – The Cochran Firm has filed a “notice of intent to sue” against North Shore Nursing and Rehabilitation Center on behalf of 65-year-old JW Thomas of Miami. Attorney Jack Paris said the family believes Thomas contracted the novel coronavirus, COVID-19 after the facility went into a mandatory lockdown.
Thomas was first admitted to Larkin Hospital for diabetic complications and then moved to a small assisted living facility. Days later, the diabetic complications to his lower leg forced him to undergo amputation surgery at North Shore Hospital. After the procedure, Thomas was admitted to North Shore Nursing and Rehabilitation for recovery.
“It is pretty clear based on the times that he contracted COVID-19 at the North Shore Nursing and Rehabilitation Center, which was under lockdown at the time,” Paris said. “The two-week incubation period shows that the home was locked down except to staff and providers. He was there much longer than two weeks and must have contracted the virus from the nursing home staff. Nobody else was allowed in or out.”
Paris said this action comes as efforts are underway in Tallahassee to limit the liability of nursing and rehabilitation facilities where the virus continues to spread.
